Journal du droit international: Issue 3 of 2026

The third issue of the Journal du droit international for 2026 has been released. It contains one article and several case notes relating to private international law issues.

In their contribution, Gustavo Cerqueira (University of Nice) and Nicolas Nord (University of Strasbourg / CIEC) analyse the Brazilian draft general act on private international law (Commentaire de l’avant-projet de loi générale de droit international privé brésilien).

The English abstract reads:

Submitted to the President of the Republic on 4 December 2025 with a view to its transmission to the National Congress, the draft general act on private international law is intended to provide Brazil with a modern and relatively comprehensive codification of the field, replacing the outdated, fragmentary and scattered rules deriving in particular from the 1942 Introductory Act to Brazilian Law. Its 42 articles cover international jurisdiction, choice of law – including the conflict of laws’ general theory (characterisation, renvoi, evasion of the law, international public policy, vested rights, overriding mandatory rules) – and international judicial cooperation in civil and commercial matters. The text enshrines significant advances: party autonomy in contractual matters and beyond, an escape clause, forum necessitatis, and the protection of weaker parties. This commentary examines both its achievements and its shortcomings – drafting imprecisions, antinomies, uncertain thresholds, regrettable silences – and concludes that the draft constitutes a much-needed modernisation of considerable merit, subject to the improvements to be made before its submission to Parliament.
