Nordic Conference on Direct Claims, Forum and Choice of Law

The Centre for Private Governance of the Faculty of Law of the University of Copenhagen and UNIDROIT Nordic Law Centre will host a conference on Direct claims, forum and choice of law on 11-12 June 2026 in Copenhagen.

Direct claims have for long been recognised in Nordic law and also in other jurisdictions. The concept is complicated and raises the question of the qualification of the claim as either contractual or tortious. Today, chains of contracts are often transnational, triggering questions of choice of forum and choice of law and the relevance of the distinction between contract and tort in this regard. This conference explores these themes seen in the light of recent developments in national court cases, dealing with national law, the CISG and uniform law, in case law from the CJEU and in new EU regulatory frameworks introducing new types of direct claims related to the green transition.

The conference will be divided in four parts:

  1. General introduction to the concept of direct claims in sales law and insurance law
  2. Direct claims and arbitration clauses
  3. Direct claims, choice of law and jurisdiction
  4. New types of direct claims in the green and digital transition
