Arzandeh on the Validation Principle and the Choice-of-Law Question
The Law Quarterly Review has published an interesting article by Ardavan Arzandeh (Associate Professor, National University of Singapore) on Validation Principle and the Choice-of-Law Question.
The article discusses the elements of the validation principle, its application in cases such as Enka Insaat Ve Sanayi AS v OOO Insurance Company Chubb [2020] UKSC 38 to choice-of-law inquiries involving cross-border contractual disputes, and why it should no longer play a significant role in such situations.
