The article discusses the elements of the validation principle, its application in cases such as Enka Insaat Ve Sanayi AS v OOO Insurance Company Chubb [2020] UKSC 38 to choice-of-law inquiries involving cross-border contractual disputes, and why it should no longer play a significant role in such situations.

The article is published on pages 613-634 of the 141 volume (2025) of the Law Quarterly Review.

It is available online via Westlaw.
